These Terms & Conditions govern your use of the trcr network monitoring platform, a service that provides continuous network probing with ICMP Ping, Traceroute, HTTP/HTTPS, DNS, and iperf3 tests, with data shipping to Elasticsearch, InfluxDB, and PostgreSQL backends.
Please read these Terms & Conditions ("Terms") carefully before using the trcr network monitoring platform ("Service") operated by trcr ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, installing the trcr agent, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, you must not access or use the Service.
2. Service Description
trcr is a network testing and monitoring platform that provides:
- Continuous network probing (ICMP Ping, Traceroute, HTTP/HTTPS, DNS, iperf3)
- Data shipping to supported backends (Elasticsearch, InfluxDB, PostgreSQL)
- A web-based dashboard for monitoring, configuration, and license management
- Full-mesh agent-to-agent measurement capabilities
3. User Accounts
To use the Service you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.
4. Licensing & Plans
Free Tier. We offer a free plan that permits monitoring of up to 5 nodes at no cost. The free tier includes access to all probe types and supported backends. No credit card is required. We reserve the right to modify the free tier limits at any time with reasonable notice.
Paid Plans. Paid subscriptions (Professional, Enterprise) unlock additional node capacity and features. Fees are billed in advance on a monthly or annual basis and are non-refundable except as required by applicable law. We may change pricing with at least 30 days' prior notice.
License Keys. Paid plans require a valid license key. Each license key is issued to a single organization and may not be shared, resold, or transferred without our written consent.
5. Data & Privacy
The trcr agent collects network telemetry data (latency, packet loss, hop information, HTTP response codes, DNS resolution times, bandwidth measurements) from your infrastructure. This data is shipped to the backend(s) you configure and may also be stored within our platform for dashboard functionality.
We do not sell your data to third parties. We use your data solely to provide and improve the Service. For detailed information on how we collect, use, and protect your data, please refer to our Privacy Policy.
You retain ownership of all data collected by your trcr agents. Upon account termination, you may request export or deletion of your data.
6. Acceptable Use
You agree not to use the Service to:
- Monitor networks or systems you do not own or have explicit authorization to monitor
- Conduct denial-of-service attacks or generate excessive traffic that degrades service for others
- Attempt to gain unauthorized access to our systems or other users' accounts
- Reverse-engineer, decompile, or disassemble the trcr software
- Violate any applicable local, national, or international laws or regulations
We reserve the right to suspend or terminate your access if we determine, in our sole discretion, that you have violated this acceptable use policy.
7. Intellectual Property
The Service, including all software, documentation, trademarks, and content, is owned by trcr and protected by intellectual property laws. Your use of the Service does not grant you any ownership rights in the Service or its components.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the trcr agent software solely in connection with the Service and in accordance with the plan you have subscribed to.
8. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRCR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Termination
You may terminate your account at any time by contacting us or through the self-service portal. We may terminate or suspend your access immediately, without prior notice, if you breach these Terms.
Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) shall continue to apply.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which trcr is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.
